Unfortunately i think it was a smart move, and now i think there is a chance he will get off, even though i think he is guilty.

It wasn’t the last minute. He wasn’t expected to give evidence and it is his right to refuse. His lawyer probably advised him not to as he would have a high chance of incriminating himself. Would have been more of a shock had he agreed to take the stand
