How can I catch him out??

Answered 4 years ago

So here’s the story. I’m the woman paying child support. I earn more than him but as a previous wife of his for 19 years I know he is capable of working cash in hand. His tax return was 10k less than mine and therefore made my child support payments to him go up by 350pm.

Ask for more time with the kids and then hire a nanny. Use his money to pay for it.

Just make him responsible for all child related expenses

This is what I do. My ex and I share care of our kids, he only works two days a week so I have to pay him child support. I let him pay for most of the kids stuff.

Lol I know a single mother who does this so we have to pay more child support no cares when the woman do it because it's better for children so no one should care when the men do it. Equal opportunity rorting.

Or another thought ......
It's more that the ex is working cash in hand, which is not counted in his income affecting the amount of child support payable.
Also the amount of tax he pays on his declared income. If he does a lot of 'cash in hand', he might / could be claiming heaps of extra payments from Centrelink, like rent assistance, health care cards etc

But it didn’t bother you when he was doing this and you were together. ..., why didn’t you report him then. .... pot .... kettle.

She said he was capable of cashies, not that he actually did cashies. Maybe he did cashies to hid money from his wife &/or family.

Be honest. Its not about dodging tax, or you'd have written that in your original post.
Who cares, op, its money for your kid. End of story.

I'm sorry but I have to agree with this. It costs a lot more to raise a kid than what you would have to pay in child support, and that extra money he is making would be going back to your kids as well so what's the problem? If you don't like it try having an adult conversation with him about maybe paying less or making it up in other ways. Be thankful its not the opposite way around. I know for a fact my ex works cash and uses centrelink to pay for child support which means I get a measly $16 a fortnight while he is living it up, and he hasn't seen them in over 3 years so he sure as hell isn't paying for them in any other way. Be thankful your kids have a parent who is trying to do the best they can.

I struggled and couldn't make ends meet, my ex wanted the kids half the time and got Friday Saturday and Sunday so he didn't have to pay as much. I ended up sending the kids to live with him full time, and was happy to pay child support.

As long as things worked for you and the decision was one you all were OK with! Children are expensive these days

It worked for and the kids they no longer had to have broken shoes taped up so they could wear them.

You may have to just let it go

You can't, lots of people do this, and even if you get evidence the ato probably won't do anything about it. The only thing I can suggest is to just not pay it.

My ex is meant to pay $12,000 this year, because my income is half his. Last financial year it was only $6240 because I had two jobs the previous year. But he does it because they are his children and he knows when we're struggling and things are tight, and when we're going OK and money isn't a worry.
It is sucky but that's how it is because when you work it out after he pays tax and then child support he's probably only left with $50k. Seems kinda mean

He’s taking responsibility for his kids and so are you - it’s nice of you to consider his position though. It’s good when the parents are reasonable adults to each other!

Child support is not set up to protect the payer. The receiver can put in a “provisional income” and provide no evidence. The payer is required to provide evidence of any income drops. Cash is hard to track and you will have your work cut out for you.

My sister hired a private investigator then reported her ex and his employer to the ATO with the evidence, and subsequently child support after the ATO investigation. It took 2 years, she didn't get that lost money back (maybe never will) but at least he was held accountable and can't do it any more in the future without the risk of prison.
